矿产资源开发中环境问题的法律对策
摘 要
矿产资源是社会经济发展的重要条件，但开发利用矿产资源必须与环境保护协调发
展。矿产资源开发中所引起的环境问题主要包括：对自然文化景观的破坏；对地质结构
的影响；矿山的废水、废气与固体废弃物等。就中国而言，矿产开发中的环保问题产生
的原因主要有采矿许可证制度本身的不完善；地方经济利益的趋势；各行政部门管理职
权的混乱，缺乏协调统一等等。针对这些问题，笔者在现有法律资源背景下，提出了一
系列解决措施。首先，要完善“三同时”、环境影响评价、环境资源税收等制度；其次
要加强执法监督、明确各部门职责、加强配合；再次，要加强矿山环境调查、监测以及
灾害防治；最后提出了要建立多元的矿山环境治理投资机制。

environmental protection problem in mineral resource exploitation is not good and lack of law
a nd li cenc e f o r e xp l o it a tio n m i ner a l; an d b e n ef i t t end e nc y of lo c a l eco n om y ; c onf u sin g o f
management of different government department; lack of correspondeny and consistency in
management and so on; To these problems , author present a series of method to solve them
i n e x i s t e n t l a w s . T h e F i r s t , c o n s u m m a t i n g t h e r e - p r o j e c t a t s a m e
time、building relevant regulation in the evaluation to environmental influence and revenue
t o e n v i r o n m e n t a l r e s o u r c e ; T h e S e c o n d , e n h a n c i n g s u r v e i l l a n c e i n e x e c u t i n g t h e l a w ,
v a l i d a t i n g r e s p o n s i b i l i t y a n d c o o p e r a t i o n o f d i f f e r e n t d e p a r t m e n t . T h e T h i r d , e n h a n c i n g
investigation of mine environment、monitoring and prevention and cure to environment .At
last, author put forword the method to build multi-management system to investment in mine
environment renewal and build the view of continuate developing.
